SCMV Privacy Policy

This “Privacy Policy” is designed to notify you about how Seltzer Caplan McMahon Vitek, a California law corporation (“SCMV”), collects, uses, discloses, transfers, and otherwise processes personally identifiable information (collectively, “Personal Information”) as well as non-personally identifiable information (collectively, “Passive Information”) that we collect on this site (www.scmv.com). Each time you visit the site, you consent to the collection, use, disclosure, and processing of Personal Information and Passive Information in accordance with this Privacy Policy. In particular, you consent to the transfer of your Personal Information to our servers and computer systems anywhere in the world, including to countries that may not provide an equivalent level of data protection to the laws in your home jurisdiction. If you provide any Personal Information that relates to another person you hereby state and agree that you have obtained proper consent from such person for the use, disclosure, and processing of such Personal Information as described in this Privacy Policy.

Collection of Personal Information

The site actively collects Personal Information from you when you register with the site, when you send any e-mail to the site administrator, and when you submit any information to the site. The kinds of Personal Information you may provide include your name, address, phone number, e-mail address, user ID, credit card information, and other information that you include in any communication or submission. In the course of representing you, you may also provide certain other types of Personal Information to us through this site, through our on-line client portal, via email or by other means. Such additional Personal Information may include highly sensitive personal information including information provided to us in connection with your legal representation which could include your social security number, EIN number, other personal, corporate or asset-specific or liability-specific identification, license or other registration numbers.

Collection of Passive Information

The site may also passively collect certain kinds of non-personally identifiable information that reveal the frequency with which you visit the site, the times and dates of your visits, the pages you reviewed, your purchase/payment history, products/services that you view, persons with whom you interact and other information (collectively, “Passive Information”). We also may use a third-party tracking service that uses tracking technologies to track Passive Information about visitors to our site in the aggregate. SCMV does not rent, sell or share Personal Information about you with other people except as expressly set forth herein. We may use this Personal Information to provide legal services to you, to communicate to you, to register you with the site, open an account with SCMV and/or this site, to process purchase orders, payment transactions or retainer deposits that you place through the site, to post your submissions to the site and to provide information to others regarding your use of the site and/or in connection with SCMV’s representation of you. We may disclose or store your Personal Information with/to third party service providers performing services on our or your behalf, including third-party website hosting services, third-party law firm practice management software providers, third-party merchant payment providers, and third-party server or data storage providers. Certain other of your Personal Information may be shared with other third-parties as required for us to provide the services you request or authorized us to perform on your behalf.

We also may disclose or transfer Personal Information (and any related information) as required by law; in urgent circumstances to protect personal safety, the public or this site; to third-parties (pursuant to a written confidentiality agreement) in connection with any sale, assignment, or other transfer of all or a part of our business or company. Notwithstanding any other provision herein to the contrary, the foregoing is not intended to and does not apply to any information protected by the attorney/client privilege.

When you engage in an on-line payment transaction, we will facilitate the transfer of your name, address, credit card details, and purchase amount as necessary for the third party to provide that service. Credit card information is collected by our PCI-compliant third-party payment processors (via web-portals they maintain and control) and are transmitted over a secure encrypted connection and stored in a datacenter until the transaction is completed, at which point it is removed unless you have requested to store your credit card details securely with the credit card processor for future transactions. To the extent your Personal Information is transmitted to the previously referenced third-party service providers, each of their own privacy policies and data security policies will also apply to such Personal Information.

We may also use Personal Information to notify you about products, services or news events that may be of interest to you. We may respond to subpoenas, court orders, or legal process or to establish or exercise our legal rights or defend against legal claims.

The site may at times combine Passive Information (as described above) with all or some types of Personal Information and such information may be stored digitally or in hard-copy as part of your profile and our records.

If you wish to subscribe to a newsletter that we may offer to you, we will use your name and email address to send the newsletter to you. Out of respect for your privacy, we will provide you a way to unsubscribe.
