Brian Katusian Presents on Controlled Group Rules and Legal Ethics

At SCMV we believe it is important for our attorneys to share their knowledge and expertise with the business community. Associate Brian Katusian has been actively involved in this endeavor.

Within the past few months, Brian was the featured speaker at an educational program of the Western Pension & Benefits Council of San Diego, presenting on the impact of the Patient Protection and Affordable Care Act (ACA) on employer-sponsored retirement plans, specifically in connection with the “Controlled Group Rules” that operate to aggregate employees of multiple employers for various retirement plan purposes (as if the employees were all employed by one single employer).  The “Controlled Group Rules” are complex and often-times overlooked or improperly applied.  Violations can result in crippling sanctions including, but not limited to, revocation of a retirement plan’s IRS tax-exempt status.  It is important to maintain employer awareness of these issues, and now even more important than ever given the integration of these rules with various ACA provisions.

Brian also was a legal ethics presenter at the State Bar of California Taxation Section’s prestigious 2015 Annual Income Tax Seminar, co-sponsored by the California Society of CPAs and the California Association of Attorney-CPAs, speaking on “Ethical Issues in Tax Practice and Procedure.”
